Employer Nomination Scheme (subclass 186) visa is a permanent residence visa for skilled workers. It allows you to work in Australia under one of three streams:
Features:-
- the Temporary Residence Transition stream
- the 186 Direct Entry stream and
- the Labor Agreement stream.
Following eligibility the skilled workers must have:-
- Nominated by an approved Australian employer
- The candidate must be under 45 years of age
- Fulfill the criteria for having the skills, qualifications, and proficiency in the English language
- And meeting the other requirements which are necessary for the streams of this visa.
Skilled workers from the developing countries intend to go to Australia and live permanently. An employer might be able to nominate a skilled worker for this visa under this stream if he:-
- Wants to actively and lawfully operate a business in Australia
- will be nominating the worker for a position in his business
- Has a genuine need for a paid employee to fill a position of the skilled worker
- Can offer a skilled position that is full-time and ongoing for at least two years with no express exclusion included in the employment contract of this period being extended in future
- Can meet the salary and employment condition requirements and have the capacity to pay the worker at least the annual market salary rate for two years
- Wishes to fill a position that is an occupation listed for the relevant visa program (for example, a subclass 186 or 187 visa) on the list of eligible skilled occupations.
Employer nomination scheme visa involves a two-step process, firstly, nomination by an Australian employer and then an application under the nominated stream. This visa permits any person along with the family unit who has been granted to:-
- stay in Australia for an indefinite period
- work and study in Australia
- enroll in Medicare, Australia’s health-related scheme care, and expenses
- apply for Australian citizenship (if you are eligible)
- sponsor eligible relatives for permanent residence
- travel to and from Australia for five years from the date the visa gets the grant (after that time, the candidate will need a resident return visa or another visa to return to Australia).
Workers in Australia
This community includes visa holders with permission to work in Australia. They have an authorization and right to work under Australian workplace law. The Fair Work Ombudsman’s Pay and Conditions Tool (PACT) provides information on pay rates, shift calculations, leave arrangements and notice and redundancy entitlements to employers and workers.
Nomination of workers takes place by the authorized entities. Such as:-
- There is no adverse information known about business or activities, the candidate has an association with, or it is reasonable to disregard this information
- The worker holds (or is eligible for) mandatory registration, license or professional membership
- The person complies with Australian immigration and workplace relationship laws
- The person, who meets the additional requirements of the stream, keeps the right to nominate the workers.
